The Georgian Competition and Consumer Agency (GCCA) has concluded that a promotional campaign jointly linked to LLC ‘Tineti’ and TBC Bank did not violate Georgia’s competition legislation.
The review focused on a summer 2024 campaign run on the swoop.ge platform which is administered by Tineti. The promotion applied exclusively to hotel and accommodation services, was offered only through swoop.ge, and was available to customers making payments with a TBC Mastercard.
Following an assessment of the factual and legal circumstances, the Agency determined that no exclusive agreement existed between Tineti and TBC Bank, either in written form or through informal arrangements. As a result, the GCCA found no infringement of the Law of Georgia on Competition.
At the same time, the Agency issued a formal recommendation to TBC Bank, advising that future contractual arrangements be designed so as not to create unjustified barriers for consumers or service providers. The GCCA emphasized that exclusive conditions should be applied only where objectively justified and proportionate, particularly in cases involving entities with a strong or dominant position in the market.
