The condition of activist Nino Datashvili has worsened in prison, prompting her lawyers to file a motion to postpone the trial. Her attorney, Tamar Gabodze, says it is essential that Datashvili be personally involved in the consideration of her case.
Gabodze stressed that both the prosecution and the court should have considered the risks to Datashvili’s health when deciding on pretrial detention.
“What we have been warning about all along has now been confirmed — Nino’s health has deteriorated under prison conditions. When the prosecution requested detention, they were obliged to take this into account. Today, the judge read a letter signed by the chief doctor of the penitentiary, confirming that Nino’s condition is so serious she cannot attend the session. We therefore filed a motion to postpone the proceedings, as her participation is crucial,” Gabodze said.
The defense also raised concerns about an expert opinion they claim was obtained illegally. However, the court postponed discussions on this matter.
Datashvili was arrested on June 20 following an incident on June 9 and is charged under Part 3 of Article 353 of the Criminal Code of Georgia, which concerns assaulting a public servant in the performance of official duties. The charge carries a penalty ranging from a fine to 4–7 years of imprisonment.
