The Commission welcomes the amendments to the Organic Law of Georgia on Common Courts, nevertheless, there are a number of outstanding recommendations that should be reconsidered, – reads the report of the Venice Commission on the appointment of judges of the Supreme Court of Georgia.
“The Venice Commission welcomes the Organic Law of Georgia on Amendments to the Organic Law of Georgia on Common Courts, which has taken into account several recommendations made in the Venice Commission’s previous opinions on the Law on CommonCourts.
“Nevertheless, there are a number of outstanding recommendations that should be reconsidered. In this respect, the Venice Commission makes the following key recommendations:
1. To consider modifying the composition of the HCoJ for the subsequent decisions;
2. To stay the appointment procedure until a decision is rendered by the QualificationChamber of the Supreme Court;
3. In order to ensure that there is an equality of treatment of candidates, the selection procedure may need to be restarted,” reads the conclusion of the report.
